1. Acceptance of Terms

By purchasing or accessing From Stuck to Selling™ (“the Program”), you agree to these Terms & Conditions.

These Terms form a legally binding agreement between you (“the Student”, “you”) and Kida Digital (“we”, “us”, “our”).

2. Program Overview

From Stuck to Selling™ is an educational guided Shopify build program designed to support small business owners in learning how to build and launch their own Shopify store.

The Program may include:

  • pre-recorded educational content

  • downloadable resources

  • templates and worksheets

  • community access

  • live group coaching calls

  • optional 1:1 coaching sessions

  • bonus modules and guest training

We reserve the right to update, improve, modify, or remove content at any time.

3. Educational Purposes Only

The Program is intended for educational and informational purposes only.

We do not guarantee:

  • business success

  • financial outcomes

  • sales performance

  • advertising results

  • revenue growth

  • or specific business outcomes

Your success depends on many factors outside our control, including:

  • your effort

  • implementation

  • market conditions

  • product viability

  • pricing

  • branding

  • and customer demand

4. Student Responsibility

You acknowledge that:

  • you are responsible for your own business decisions

  • implementation is your responsibility

  • results will vary between students

  • the Program does not constitute legal, financial, taxation, or professional advice

We recommend obtaining independent professional advice where required.

5. Payments & Pricing

All prices are listed in AUD unless otherwise stated.

Payment must be made in full or through an approved payment plan before access is granted.

Failure to complete payment instalments may result in:

  • suspension of access

  • removal from the community

  • cancellation of bonuses or coaching access

6. Refund Policy

Digital Product Policy

Due to the digital nature of the Program and immediate access to intellectual property, downloads, templates, resources, and educational materials, refunds are generally not provided for change of mind.

However, nothing in these Terms excludes your rights under Australian Consumer Law.

Under Australian Consumer Law, you may be entitled to a remedy if the Program:

  • is not delivered as described

  • contains major faults

  • or does not meet consumer guarantees

7. Access Period

Students receive access to the Program for the access period specified at the time of purchase.

Founding Members may receive extended access periods and bonuses as outlined during the promotional period.

Access may be revoked if these Terms are breached.

8. Community Conduct

Students participating in the FS2S Champions Community agree to:

  • behave respectfully

  • avoid harassment or discrimination

  • not spam or self-promote excessively

  • maintain confidentiality of other students

We reserve the right to remove members from the community without refund if behaviour is deemed inappropriate, abusive, harmful, or disruptive.

9. Intellectual Property

All Program materials remain the intellectual property of Kida Digital unless otherwise stated.

You may not:

  • reproduce

  • distribute

  • record

  • share

  • resell

  • upload

  • copy

  • or commercially exploit

any part of the Program without written permission.

This includes:

  • videos

  • templates

  • worksheets

  • community content

  • frameworks

  • recordings

  • branding materials

Access is granted for individual personal business use only.

10. Coaching & Support

Any coaching, feedback, or support provided:

  • does not create an agency relationship

  • does not constitute legal or financial advice

  • is educational guidance only

1:1 sessions must be booked through the approved booking system and are subject to availability.

11. Third-Party Platforms

The Program may reference or integrate third-party services including:

  • Shopify

  • Meta

  • Canva

  • ChatGPT

  • payment gateways

  • or other software tools

We are not responsible for:

  • outages

  • subscription fees

  • pricing changes

  • policy changes

  • account restrictions

  • or functionality changes made by third-party platforms

12. Limitation of Liability

To the maximum extent permitted by law, Kida Digital will not be liable for:

  • loss of profits

  • loss of business opportunity

  • indirect or consequential loss

  • advertising losses

  • business interruption

  • technical failures

  • or data loss

Our total liability is limited to the amount paid for the Program.

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.

13. Termination

We reserve the right to suspend or terminate access to the Program if:

  • payment obligations are not met

  • these Terms are breached

  • intellectual property is misused

  • or community standards are violated

14. Privacy

Any personal information collected will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.

15. Governing Law

These Terms are governed by the laws of Australia.

Any disputes arising in connection with the Program will be subject to the jurisdiction of the Australian courts.
